1. Acceptance of Terms
By accessing or using www.colewencley.com (the "Site") or booking a coaching session with Midnight Jaguar LLC ("we," "us," or "our"), you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the Site or our services.
2. Services
We offer one-on-one spiritual and life coaching sessions delivered via telephone or video call. All sessions are provided by Cole Wencley through Midnight Jaguar LLC, a Texas limited liability company.
Coaching is not therapy, counseling, medical treatment, healthcare, legal advice, or financial advice. Notwithstanding Coach’s licensure in other professional fields, no coaching session constitutes or shall be construed as acupuncture, healthcare, or any other licensed professional service. See our full Coaching Services Agreement for complete terms governing individual sessions.
3. Booking and Payment
Sessions must be booked and paid for in advance through our online booking system. Full payment of $125.00 USD is required at the time of booking. We accept credit and debit card payments processed securely by our third-party payment processor.
Your booking is confirmed only upon receipt of full payment and a confirmation email from us.
4. Cancellation and Rescheduling
All sales are final. We do not offer refunds for any reason, including cancellation or no-show. Clients may reschedule one time at no charge with at least 24 hours’ notice prior to the scheduled session. No-shows forfeit the session entirely.
5. Intellectual Property
All content on this Site, including text, graphics, logos, and any materials shared during sessions, is the property of Midnight Jaguar LLC and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use our content for commercial purposes without prior written consent.
6. Disclaimer of Warranties
THE SITE AND OUR SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY SPECIFIC RESULTS WILL BE ACHIEVED THROUGH OUR COACHING SERVICES.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MIDNIGHT JAGUAR LLC AND COLE WENCLEY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THIS SITE OR OUR SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SESSION IN QUESTION.

Our Site may contain links to third-party websites. We are not responsible for the content, privacy practices, or accuracy of any third-party sites. Links do not constitute endorsement of those sites or services.
9. Email Communications
By subscribing to our email list or contacting us through the Site, you consent to receiving emails from us. You may opt out at any time. We will not share your email address with third parties for marketing purposes.
10. Governing Law
These Terms & Conditions are governed by the laws of the State of Texas. Any disputes arising under these terms shall be resolved in accordance with the dispute resolution process outlined in our Coaching Services Agreement, and venue shall be in Austin, Texas.
11. Changes to These Terms
We reserve the right to update these Terms & Conditions at any time. Changes will be posted on this page with an updated effective date. Continued use of the Site constitutes acceptance of the revised terms.
